UW-Stout has adopted the following guidelines regarding Name, Image, and Likeness:
- Student-athletes are permitted to engage in legitimate NIL agreements beginning July 1, 2021. Legitimacy requires that compensation be provided only for work actually performed.
- Student-athletes are required to disclose NIL activities through the prescribed institutional form no later than seven days (one calendar week) after entering into an oral or written NIL agreement.
- NIL activities are not permitted during team-related activity. On competition days, this extends from the time a student-athlete reports until the student-athlete is released from participation.
- Student-athletes will not be permitted to enter into contracts for use of their name, image, and/or likeness in any Prohibited Sponsorship Category unless prior approval is received. The list of Prohibited Sponsorship Categories may be updated from time to time by the University. In the event a student-athlete enters into a commercial relationship in a Prohibited Sponsorship Category without prior approval, the University in its sole discretion may require the student-athlete to terminate such relationship.
- Prohibited Sponsorship Category. “A Prohibited Sponsorship Category” is any sponsorship agreement in certain product categories, with specific entities and/or with identified individuals that are in conflict with existing University contracts, University policy or for any other reason determined in good faith by the University. Prohibited Sponsorship Categories include, but are not limited to, sponsorships that: (1) adversely affect the University’s reputation; (2) appear to create an endorsement by the University of a particular company, product, political candidate or position regarding public policies; (3) are considered to contain obscene, indecent or profane material; (4) ridicule, exploit or demean persons on the basis of their age, color, creed, physical or mental disability, physical appearance, national origin, citizenship, veteran status, marital status, race, religion, sex, sexual orientation, gender or gender identity; (5) promote alcohol or tobacco products; (6) promote NCAA banned substances; or (7) promote gambling/sports wagering.
- Student-athletes are not permitted to engage in NIL activities that conflict with exclusive institutional sponsorships.
- Student-athletes are not permitted to sell or exchange any gear, equipment, or apparel provided by University of Wisconsin-Stout until no longer a student-athlete.
- Student-athletes wishing to use University of Wisconsin-Stout marks and logos must obtain pre-approval from the Trademark Licensing Office or appropriate department.
- Student-athletes wishing to conduct NIL activities in University of Wisconsin-Stout facilities must obtain pre-approval through the appropriate institutional authority. Incidental use is not subject to pre-approval but may be reviewed for consistency with institutional policies, mission, and goals.
- Student-athletes will receive NIL-related educational opportunities through eligibility and compliance meetings, team meetings and athletic director meetings. The institutional document will reside on the website.
- University of Wisconsin-Stout employees are subject to state ethics laws and institutional policies governing involvement with private entities while acting in an official capacity and use of institutional resources for private gain. Ethics questions should be directed to the University of Wisconsin-Stout Compliance Director Travis Destache or the UW System Offices of Compliance and Integrity or General Counsel.
- University of Wisconsin-Stout and its staff and boosters are prohibited from arranging, developing, or facilitating any NIL agreements for prospective or current student-athletes as an inducement, impermissible benefit, or pay-for-play agreement.
- Student-athletes are permitted to contract with an agent or lawyer for the purpose of marketing the student-athlete’s name, image, and likeness. Contracts with professional sports agents remain impermissible. Any agent or lawyer wishing to contract with University of Wisconsin-Stout student-athletes must comply with relevant state laws and register with the institution.
- NIL compensation may impact eligibility for need-based financial aid (e.g., Pell Grant). Questions should be directed to the UW-Stout Financial Aid department at finaid1@uwstout.edu or (715) 232-1363.
- NIL compensation may have tax consequences and student-athletes are encouraged to seek tax advice.
- International student-athletes are strongly encouraged not to enter into NIL agreements because of potential adverse impacts to their immigration status or student visas. Questions can be directed to the UW-Stout Office of International Education at globaled@uwstout.edu or (715) 232-2132.
